TERMS AND CONDITIONS for accessing and using the SÍSEI portal of SOLUCIONES ESTRATÉGICAS EN INFORMACIÓN S.A.S. (SEI)
1. TITLE AND PRESENTATION

This document establishes the terms and conditions governing access to and use of the web portal, which we refer to as SÍSEI. This portal is owned and operated by Soluciones Estratégicas en Información S.A.S. (SEI).

Access, navigation, and use of the portal imply full and unreserved acceptance of these terms and conditions, which are mandatory and binding. We recommend that you read them carefully. If you do not agree with the content of this document, you should not continue with the registration process or use the services of the portal. Continued use of the portal after any modification made by SEI will be considered tacit acceptance of the new terms.

2. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
All intellectual and industrial property rights over the content, design, software, databases, trademarks, logos, trade names, and other elements of the portal are the exclusive property of SEI or their respective owners. Use of the portal does not confer any license, authorization, or right to use such elements. Reproduction, distribution, modification, copying, disclosure, or any other unauthorized use is prohibited without the prior written consent of SEI.
3. LINKED SITES (THIRD-PARTY LINKS)
The portal may include links to third-party websites. SEI is not responsible for the truthfulness, accuracy, content, privacy policies, or security practices of such sites. The inclusion of these links does not imply SEI’s approval, sponsorship, or endorsement of the products or services offered by third parties. It is your responsibility to review the terms and policies of such sites before interacting with them.
4. RESPONSIBLE USE OF THE PORTAL

Use of the portal is at your own risk. The user agrees to:

  • Use the portal diligently and securely, from reliable devices and networks.
  • Maintain the confidentiality of your access credentials (username and password) and not share them with third parties.
  • Immediately inform SEI of any unauthorized use or suspected breach of their account.
  • Not to engage in activities that may affect the security, integrity, availability, or functionality of the portal, including the use of malicious software (malware), viruses, denial-of-service attacks (DDoS), or any other action that may damage SEI’s hardware, software, or systems.
5. USER COMMITMENTS AND RESPONSIBILITIES
The user is solely responsible for their use of the portal and for the information they provide. They shall indemnify, defend, and hold SEI harmless from any claim, demand, fine, or penalty arising from a breach of these terms or misuse of the portal. SEI reserves the right to take legal action and seek compensation for any damages caused.
6. SUSPENSION AND CANCELLATION OF THE SERVICE

SEI reserves the right to suspend, cancel, or terminate, temporarily or permanently, access to the user account or all of the portal’s services, at any time and without prior notice, in the event of:

  • Breach of these terms and conditions.
  • Misuse of the portal or your access credentials.
  • Suspicion of fraudulent or illegal activities.
  • Technical, security, or maintenance reasons.
7. SERVICE AVAILABILITY
SEI will endeavor to ensure the availability and continuous operation of the portal. However, it does not guarantee that access will be uninterrupted or error-free. The service may be temporarily interrupted due to maintenance, updates, technical failures, power supply, or events of force majeure. SEI shall not be liable for any loss, damage, or harm that may arise from such interruptions.
8. MODIFICATIONS TO THE PORTAL AND SERVICES
SEI reserves the right to modify the design, structure, and functionalities of the portal, and to add or remove services at any time and without prior notice.
9. MODIFICATION OF TERMS AND CONDITIONS
SEI reserves the right to unilaterally modify these terms and conditions at any time. Modifications will take effect from the moment they are published on the portal. Continued use of the portal after the publication of changes constitutes express and full acceptance of those changes.
10. LIMITATION OF LIABILITY

SEI shall not be liable for any direct or indirect losses, damages, or injuries that users or third parties may incur as a consequence of:

  • Improper or negligent use of the portal.
  • The user’s ignorance of these terms.
  • Incompatibility of the user’s devices or software.
  • Viruses, malware, or computer attacks that are not under SEI’s control.
  • Failures or interruptions in the service of external providers.
11. PRIVACY POLICY AND PERSONAL DATA PROTECTION
The personal information provided by the user will be processed and stored in accordance with SEI’s Personal Data Processing and Protection Policy, which is available here. By accepting these terms, the user declares that they have read, understood, and accepted this policy.
12. USE OF ELECTRONIC SIGNATURES AND LEGAL VALIDITY OF DOCUMENTS

The user understands and accepts that, through the portal, they may formalize legally valid documents, including, but not limited to, employment contracts, addenda, agreements, and certifications. Acceptance of these documents through the use of buttons such as “Accept,” “Sign,” or similar actions constitutes an electronic signature and shall have the same legal force and validity as a handwritten signature, in accordance with the provisions of Law 527 of 1999 and other related regulations.

When performing these types of actions, the system will generate a digital trace that includes the event log, the document hash, the date and time, the IP address, and other metadata, which will serve as proof of the user’s acceptance and express consent.

13. APPLICABLE LAW AND JURISDICTION

These terms and conditions are governed by and interpreted in accordance with the laws of the Republic of Colombia. Any dispute or controversy arising from the interpretation or enforcement of this document shall be submitted to the jurisdiction of the competent judges and courts of the city of Bogotá, D.C.
